I. PURPOSE

These terms of use are established by DATINTEL, S.L., hereinafter referred to as Golden Owl®, to set forth the criteria and conditions of use of the platform and private area made available to users on this website.​

Golden Owl® reserves the right to modify its terms of use at any time, as well as to make any technical or visual improvements it deems appropriate. If the modifications affect users' privacy, users will be notified in advance before the changes take effect.

These Terms of Use govern the access and use of the services that Golden Owl® makes available to the user. These Conditions, along with other indications, documentation, or resources available on this website, will regulate the relationship between the user and Golden Owl®.

The following terminology applies to these Terms of Use, General Contracting Conditions, Privacy Policy, and all Agreements: "Client," "User," "You" and "Your" refer to you, the person accessing this website and complying with Golden Owl®’s Terms of Service. "Golden Owl®," "We," "Our," and "Us," refer to Golden Owl®. "Party," "Parties," or "Us," refers to both the Client and ourselves. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.​​

II. TERMS OF USE

a) Establishment of username and password:

Access to private areas, restricted functionalities, platforms, operational environments, or authorized services of Golden Owl® requires valid access credentials associated with an authorized User Account. Depending on the applicable security framework, access may require a username, password, Two-Factor Authentication (2FA), or equivalent authentication measures implemented by Golden Owl®.

The user undertakes to use their credentials diligently, securely, and lawfully, and agrees not to disclose, share, or make them available to unauthorized third parties under any circumstances.

The user is solely responsible for maintaining the confidentiality and security of their credentials, authentication methods, devices, and associated access mechanisms. If the user suspects or detects unauthorized access, credential compromise, identity theft, hacking, phishing, or any other security incident affecting their account, they must immediately notify Golden Owl® through the designated support channels and, where applicable, modify the affected credentials.

Golden Owl® may apply additional verification procedures, temporary suspensions, access restrictions, or other reasonable security measures where necessary to protect the integrity, security, or lawful operation of its services and platforms.

Golden Owl® recommends the use of strong passwords, secure authentication methods, protected devices, and appropriate cybersecurity practices consistent with the sensitivity of the accessed services and information.

b) Control of access to the private area:

Access to the private area, as well as to all services, actions, or benefits that may derive from it, is limited exclusively to the user registered on this website. Access must be individual.

If the user acts on behalf of a legal entity, they acknowledge having sufficient capacity and authorization to represent it.

c) Management of registration and responsibility for the data provided:

The user, as such, has the obligation to manage their registration in the private area, with all the data that are mandatory to fill in the forms found within it. In this sense, the user is responsible for all the data they provide when formalizing their registration.

Therefore, the user must guarantee the accuracy of the data provided, and commit to communicating to Golden Owl® any change or modification that occurs in relation to them. The user will be responsible for any damage that may arise from the provision of false, erroneous, or inaccurate data.

d) Third-party data:

If, during the use of our services, or in any interaction that occurs with Golden Owl®, the user provides data of third parties, we inform you that:​

  • You can only provide third-party data if you have their express consent. Therefore, by providing us with third-party data, you declare that you have the aforementioned consent, or that you have the legal capacity to express such consent on their behalf.

  • All individuals whose data you provide must be aware of the content of this section. You declare that you have informed them and made them aware of its content.

Golden Owl® is not responsible if the user who fills out the forms or reservation requests does not comply with the above points. The user will be fully responsible for any documentary fraud that may occur.

e) General rules of good conduct:

The user undertakes to use the private area and, in general, all resources, platforms, systems, and functionalities provided by Golden Owl® in accordance with these Terms of Use, applicable law, morality, generally accepted good practices, and public order.

The user agrees to use the platform solely for purposes related to their condition as a user, their relationship with Golden Owl®, or the contracted services. Consequently, the user undertakes not to engage in fraudulent uses or activities that may infringe, damage, or negatively affect the rights or interests of third parties.

The user shall not carry out actions that may damage, disable, overload, impair, interfere with, or otherwise affect the proper functioning, security, availability, integrity, or operation of the services, systems, infrastructure, or functionalities provided through the platform. Likewise, the user shall not hinder or prevent the normal use and operation of the platform by other authorized users.

The user may not use the platform as a means to store, process, transmit, distribute, or make available data, links, images, files, content, or other elements that are unlawful, discriminatory, racist, defamatory, obscene, abusive, harmful, malicious, misleading, infringing, or otherwise contrary to applicable law, public order, good faith, or the rights of third parties.

Golden Owl® reserves the right to temporarily suspend, restrict, or block access to its platform, services, or functionalities where it detects conduct, activities, circumstances, or security risks that reasonably justify such measures. Where reasonably possible and appropriate, Golden Owl® will inform the affected user in advance through the contact channels provided by the user.

Golden Owl® requests responsible, ethical, and collaborative use of its services and platforms. The proper functioning, security, reliability, and effectiveness of the platform depend on the good faith, lawful conduct, and compliance with these Terms of Use by all users.

Users are expected to use the platform ethically, proportionately, and in accordance with applicable law, avoiding any conduct that may compromise the security, privacy, integrity, rights, legitimate interests, or reputation of Golden Owl®, other users, or third parties.

III. INFORMATION SECURITY

At Golden Owl®, we are very committed to everything related to Information Security and personal data. Therefore, we apply all necessary measures to ensure the correct use and storage of the same.​

  • Security measures: Golden Owl® has implemented the necessary security measures from the design and by default to ensure the confidentiality, security, integrity, and availability of the data. Likewise and actively, it will implement any technical and administrative improvements it deems appropriate, seeking a climate of proactivity and prevention. Golden Owl® will not be responsible for theft, loss, or unauthorized access in the case of third parties who take advantage of technological evolution and unpublished security flaws to act without the consent of Golden Owl®, regardless of the purpose for which they do so. Likewise, Golden Owl® is exempt from any responsibility for the loss of information and/or confidentiality associated with cases of force majeure or fortuitous event.

  • Data protection principles: Golden Owl® complies with the data protection principles required by the GDPR (EU) 2016/679 and LOPD 3/2018. It has also included measures that facilitate the compliance of these principles regarding the data that any user processes through this platform. However, these users must comply with the principles of information, confidentiality, consent, among others, regarding personal data. Golden Owl® will only be responsible for the data processing performed by its personnel, and regarding the security measures it must apply to guarantee the confidentiality, integrity, security, and availability of the information on this platform. Any data processing different from the above will not be the responsibility of Golden Owl®.

If during your use of the platform you become aware of a possible incident, regardless of its nature, we ask you to notify us as soon as possible. The correct functioning of the system or its improvement is in everyone's hands.


IV. INTELLECTUAL PROPERTY

Unless otherwise indicated, Golden Owl® and/or its licensors own the intellectual property rights for all material on Golden Owl®. All intellectual property rights, including but not limited to the trademark, logo, content, and business model, are reserved. The user may access these materials on Golden Owl® for their personal use subject to the restrictions set out in these terms and conditions. The user may not use the information contained on this platform, nor the design, nor its graphic content without the authorization of the owners or, where applicable, of the owners of the intellectual and industrial property rights that exist over them. Otherwise, they would be infringing on intellectual and industrial property rights.

The user is not allowed to carry out reproduction, duplication, whether total or partial, nor republication, sale, rental, sublicense, copy, or redistribution of the contents, materials, design, or business model of Golden Owl®.

The user may not use the commercial name, trademark, image, or logo of Golden Owl®, except to refer to this platform or mention Golden Owl®.

V. LIMITATION OF LIABILITY

Golden Owl® shall not be liable for any damages, losses, or harm caused by any user to themselves or to third parties as a result of the breach of these Terms of Use. In all cases, legal and ethical responsibility shall rest exclusively with the infringing user, who assumes full responsibility for complying with applicable laws and with these Terms.

Users are strongly encouraged to review them carefully in order to understand in detail the scope, limitations, and exclusions of liability governing the relationship between the user and Golden Owl®.

 

VI. DISCLAIMER

Golden Owl® services, platforms, reports, intelligence outputs, digital tools, and associated functionalities are provided on an “as available” and “as applicable” basis, taking into account the operational and external-source-dependent nature of the services.

Golden Owl® applies reasonable technical, organizational, legal, and security measures consistent with applicable standards and operational practices. However, to the fullest extent permitted by applicable law, Golden Owl® does not guarantee uninterrupted availability, absolute accuracy, complete reliability, uninterrupted functionality, or suitability for every specific purpose.

Information provided through Golden Owl® may derive from public, open, deep web, dark web, third-party, licensed, automated, AI-assisted, or externally managed sources. Accordingly, Golden Owl® cannot guarantee the completeness, legality, reliability, timeliness, or accuracy of all external information or outputs generated from such sources.

The information, analyses, alerts, intelligence outputs, and related materials provided through Golden Owl® are intended exclusively for informational, analytical, operational, or strategic support purposes and do not constitute legal, financial, regulatory, compliance, investigative, or other professional advice unless expressly agreed otherwise in writing.

Users are solely responsible for independently evaluating the legality, proportionality, suitability, and consequences of any use of Golden Owl® services or outputs, particularly where decisions may affect legal rights, compliance obligations, commercial interests, employment matters, investigations, or third-party rights.

Golden Owl® shall not be liable, to the fullest extent permitted by applicable law, for indirect, incidental, consequential, reputational, commercial, or opportunity-related damages arising from the use of, inability to use, or reliance upon its services, except where such limitation is prohibited by mandatory law.

Nothing in this Disclaimer shall exclude or limit liability where such exclusion or limitation is not permitted under applicable law.

VII. PERSONAL DATA PROTECTION

Datintel, S.L. with Tax ID B56582307, and address at the Alicante Science Park, West Campus of the University of Alicante, 03005, Alicante, Spain, informs you that the personal data associated with the users of this website and, where applicable, representatives and workers of legal entities, will be processed by Golden Owl® solely to carry out the provision of the contracted service, enable access to the platform, and manage the billing and payment of its services.

The legitimization for the processing of the data is the execution of a contract (Art. 6.1.b, GDPR), compliance with legal obligations (Art. 6.1.c, GDPR), and, concerning the data of contact persons, employees, legal representatives, or similar, that data processed during the development/execution of the contract, will be processed for the proper development of the contract, based on the legitimate interest of the parties, in accordance with Article 19 LOPD 3/2018.

The personal data of the platform users will not be communicated to third parties, except for legally provided exceptions for Judges and Courts, and Public Administrations. No international data transfers are envisaged.

Physical users may exercise their rights of access, rectification, deletion, and in some cases, if applicable, the right to data portability and limitation of processing. To exercise these rights, they may request the corresponding forms from Golden Owl®, or download them from www.aepd.es. Likewise, if they are not satisfied with the response received from the other party, they may file a complaint with the Spanish Control Authority www.aepd.es.

VIII. UPDATE

Should there be updates, modifications, or changes to this document, such changes will be prominently published in this section to ensure that users are always informed of the latest versions.

IX. INDEMNIFICATION

The user agrees to indemnify and hold harmless Golden Owl®, as well as its employees, subsidiaries, affiliates, successors, assignees, directors, agents, service providers, from any claim or demand, including reasonable attorneys' fees and court costs, which may be filed by any third party due to, or arising from the content that the user submits, posts, or makes available through the services, their use of the services, their violation of the terms, their breach of any of the representations and warranties set forth, or their violation of the rights of another.​

By using our website, the user confirms their acceptance of our disclaimer, legal notice, terms of use, privacy policy, and cookie policy and agrees to comply with their terms.
